摘 要:“德治”既是中国历史上重要的治国理政范式,也是今日学术界讨论治理现代化绕不开的学术语词。遗憾的是,当今学术界缺少对“德治”概念本身的仔细辨析,对“德治”概念的理解比较随意。这种随意突出表现为将“德治”概念中的“德”随意理解为“道德规范”,进而将“德治”直接解读为“人以道德规范去治理”。用英文表述就是“rule by virtue”。在这里,“德治”变成了人以道德规范去治理的工具或手段,“德治”的主语是“人”,背后其实还是“人治”。如果非要保留“德治”这个概念,那么最好将“德治”理解为“道德自律”。用英文表述就是“rule of virtue”。在这里,“德治”就归正为“道德的自我管理、自我约束”。作出这样的归正,有助于摆脱“德治”陷于“人治”的风险,从而更好地发挥“德治”在治理现代化中的作用。“Rule of morality”is not only an important paradigm of governing the country in Chinese history,but also a academic word that is unable to go around modernization in academia today.Regrettably,academic circles lack a careful analysis of the concept of“rule of morality”itself today,and make the understanding of the concept of“rule of morality”more casual.This kind of random appears in the morality of the concept of“rule of morality”randomly understood as“moral norms”,then directly interpret“rule of morality”as“man with moral norms to govern”.The English expression is“rule by virtue”.Here,“rule of morality”has become a tool or means for people to govern with moral norms,but the subject of it is“people”,the substance of it is actually“human rule”.If we have to retain the concept of“rule of morality”,the best way is to understand“rule of morality”as“moral self-discipline”.The English expression is“rule of virtue”.Then,“rule of morality”is attributed to“moral self-management and self-restraint”.Making such a correction helps to get rid of the risk of“rule of morality”in“human rule”,so as to better play the role of“rule of morality”in governance modernization.
