摘 要:在轻罪治理的背景下,不起诉案件中适用非刑罚处置措施具有修复社会关系、预防行为人再次犯罪、维护社会稳定等积极作用。但不起诉案件中的非刑罚处置措施存在适用数量较少且比例失衡、适用范围过大、适用方法不科学、适用程序严重缺失等问题,其成因与观念陈旧、立法粗疏、成本增加等密切相关。要有效解决这些问题,应当遵循“预防修复为主、惩罚为辅”“强制与自愿相结合”“过责相当”以及“兼顾公正与效率”等原则,同时健全非刑罚处置措施的规范依据,合理界定适用范围,优化适用方法,增设适用程序,以激活和促进不起诉案件中非刑罚处置措施的司法适用。In the context of misdemeanor management,the application of non-penalty measures in nonprosecution cases has the positive effect of repairing social relations,preventing the perpetrator from committing another crime and maintaining social stability.However,there are some problems in non-penalty measures in non-prosecution case,such as small number of application,excessive scope of application,unscientific applicable methods and lack of applicable procedures.They are related to outdated ideas,rough legislation and increasing cost.In order to effectively solve these problems,we should follow the principles of"prevention and repair first,punishment supplemented","combination of coercion and voluntary","comparable fault and responsibility"and"giving consideration to justice and efficiency".At the same time,the legislative basis of non-penalty measures should be improved,the applicable scope should be reasonably defined,the applicable method should be optimized,and the applicable procedure should be added so as to activate and promote the judicial application of non-penalty measures in non-prosecution cases.
