摘  要:最高人民法院印发的《关于加强和规范裁判文书释法说理的指导意见》明确提出,除法律法规、司法解释外,“通行学术观点”可作为裁判的论据。通行学术观点属于广义上的法律学说,可从裁判的说理论证和行政法的特点等维度,考量行政裁判中法律学说援引的必要。行政裁判中法律学说的援引既有学说设定标准的多元性、学说对裁判结果影响的差异性以及学说选择的自主性等共性特征,也有行政权的监督和相对人权益的保障等个性特征。为发挥法律学说的应有功能,更好指引裁判实践,应明确学说在裁判理由中的可援引性,确立学说援引的基本要求,鼓励法官在行政裁判中援引学说,明晰学说援引的遵循原则和案件类型,规范学说援引的叙述方式与加强理由论证。The Guiding Opinion on Strengthening and Standardizing the Interpretation and Reasoning of Judgment Documents issued by the Supreme People's Court explicitly states that,in addition to legal regulations and judicial interpretations,"prevailing academic viewpoints"can be used as arguments for judgments.The prevailing academic viewpoint belongs to legal doctrine in a broad sense,and the necessity of citing legal doctrine in administrative adjudication can be considered from dimensions such as the reasoning and argumentation of judgments and the characteristics of administrative law.The citation of legal doctrine in administrative judgments has common characteristics such as the diversity of doctrine setting standards,the differences in the impact of doctrine on the outcome of judgment,and the autonomy of doctrine selection,as well as individual characteristics such as the supervision of administrative power and the protection of the rights and interests of counterparties.In order to give full play to the due role of legal doctrine and better guide the practice of administrative adjudication,it is essential to clarify the admissibility of legal doctrine in the reasons for judgment,establish the basic requirements for citing legal doctrine,encourage judges to cite doctrine in administrative judgments,clarify the principles and types of cases,standardize the narrative methods and strengthen the argumentation of reasons.
