摘　　要：美国1965年《初等与中等教育法》是联邦教育援助立法史上的一次重要突破,其快速通过的原因主要有四个方面:第一,美国在20世纪60年代所面临的城市学校危机、民权运动高涨和贫困加剧这三大问题为1965年《初等与中等教育法》增强了立法合理性。在贫困文化理论的影响和政府对经济政策的考量下,教育成为调和社会冲突和缓解贫困的重要工具。第二,1950年的“影响援助计划”和1958年的《国防教育法》在突破保守派的阻碍和增强政治吸引力方面为该立法提供了可资借鉴的路径和模式。此外,1964年《民权法案》的出台缓解了1965年《初等与中等教育法》涉及的种族争议问题。第三,1961—1965年完成了一系列有利于法案通过的政治变革,为1965年《初等与中等教育法》扫清了立法程序上的障碍。第四,教育政策精英就1965年《初等与中等教育法》涉及的政治争议达成了一定共识,从而推动了法案顺利通过。由此可知,在美国公共教育系统的各个方面,联邦政府都有着周密的设计与安排,这体现了美国公共教育中的联邦职能。The Elementary and Secondary Education Act of 1965 is a breakthrough in the history of federal education aid legislation,breaking the deadlock of related legislation.There are four main reasons for its smooth passage.First,the three major crises facing the United States in the 1960s including the decline of urban schools,civil rights movement and poverty strengthened legislative rationale for the act.Under the influence of the culture-of-poverty theory and the government’s economic policy considerations,education became an important tool to reconcile social conflicts and alleviate poverty.Second,Impact Aid Program of 1950 and National Defense Education Act of 1958 provided legislative path and model for breaking through the conservatives’barriers and enhancing the political appeal of the act.In addition,the enactment of Civil Rights Act of 1964 diluted the racial controversy surrounding ESEA.Third,a series of political changes conducive to the passage of ESEA were conducted from 1961 to 1965,clearing the obstacles in legislative process.Fourth,educational policy elite reached a consensus on the political disputes involved in the act,thus promoting its smooth passage.Therefore,in all aspects of the American public educational system,the federal government has a careful design and organizational arrangement,which embodies the federal functions in American public education.
