数字时代刑事诉讼中人的主体地位

摘　　要：在刑事诉讼中确立人的主体地位具有重要意义。判断何者为刑事诉讼主体,需遵循特定标准。在数字时代,新型工具的运用对人在刑事诉讼中的主体地位构成了威胁,尤其是刑事诉讼中运用的智能化工具已经初步形成“类主体”的地位,冲击了办案人员和当事人的刑事诉讼主体地位,导致人的尊严受到贬损。在此种情形下,基于明确工具服务于人的目的、兼顾“目的合理性”和“价值合理性”、警惕技术逻辑之必要,应重新强调数字时代刑事诉讼中人的主体地位,并从规则层面保障人的主体地位。首先,应明确工具在刑事诉讼中的辅助性地位;其次,应充分保障当事人在刑事诉讼中的参与权;最后,应落实司法责任制的要求,保证办案人员在办理刑事案件时权责统一,从而保障人的主体地位。Establishing the subject status of persons in criminal procedure is of great importance.To determine who are the subjects of criminal proceedings,specific standards must be followed.The application of new types of tools in the digital age has posed a threat to the subject status of persons in criminal procedure,and particularly intelligent tools used in criminal procedure have begun to form a“quasi-subject”status,which has undermined the subject status of case handlers and parties involved,leading to the derogation of human dignity.Under such circumstances,based on clarifying that tools serve human,balancing“teleological rationality”and“axiological rationality”,and being vigilant against the technological logic,it is essential to re-emphasize the subject status of individuals in criminal proceedings in the digital era and safeguard the subject status of persons from the perspective of rules.First,the auxiliary role of tools in criminal procedure should be clearly defined.Second,the participation rights of the parties in criminal procedure should be fully protected.Third,the requirements of the judicial responsibility system should be implemented to ensure the unity of power and responsibility of law enforcement personnel in handling criminal cases,to achieve the protection of the subject status of persons.
