摘 要:“数字技术—行政程序—行政行为”的赋能模式在提高行政效率方面取得了显著成效,但由于技术固有的明显的工具理性和技术逻辑,行政权相对于个体权利的不对称优势,在行政程序数字化场景中进一步强化,并与传统正当程序理念产生了背离。以程序公正为倡导,技术性正当程序从算法设计的源头所构建的系列规则和原则,演化成了“系统架构—程序革新—系统修正”三阶修正模型,而以系统化的透明性与一致性、层次化的交涉机制、多元化的人工介入模式为内容的行政程序数字化的规制路径,则形成了技术性正当程序的完整制度方案。The empowerment model of“digital technology-administrative procedure-administrative behavior”has achieved significant results in improving administrative efficiency.However,due to the inherent instrumental rationality and technical logic of technology,the asymmetric advantage of administrative power over individual rights has been further strengthened in the digital landscape of administrative procedures,and has deviated from the traditional concept of due process.Advocating for procedural fairness,the series of rules and principles constructed from the source of algorithm design in technical due process have evolved into a three-level correction model of“system architecture-program innovation-system correction”.The regulatory path of administrative procedure digitization,which includes systematic transparency and consistency,hierarchical negotiation mechanism,and diversified manual intervention mode,has formed a complete institutional solution for technical due process.
