体育“饭圈”的现象透析与法律纾困

摘　　要：体育“饭圈”是粉丝因相似的趣缘需求聚集而成的身份认同群体,共同组成特殊的圈层结构。粉丝对内通过平台实现资本积累,对外则基于身份歧视与其他群体形成对立。体育“饭圈”成员因其对群体的深厚认同与忠诚,使得部分粉丝存在观赛时不恰当应援､赛后发布“竞争性事实”､散布虚假信息以及充当“粉丝警察”等失范行为,不断危害体育行业发展并挑战法律底线。基于此,提出体育“饭圈”治理更具法律威慑力的相关措施:从明确平台信息审查义务､优化对话机制与完善举报机制方面明确平台治理责任;通过体育“饭圈”外部惩戒与自律自治相结合,构建体育“饭圈”治理法规制度体系;加强未成年人网络保护方面的立法､规范与监管引导;廓清运动员与体育协会在体育“饭圈”治理中的参与义务。The sports“fandom”is an identity community formed by fans gathering for similar interests and needs,whereby forming a special circle structure together.Fans accumulate capital internally through the platform;Externally,opposition develops towards other groups based on identity discrimination.Due to their deep identification and loyalty to the group,some fans have inappropriate support when watching the game,publishing“competitive facts”after the game,spreading false information,and acting as“fan police”,constantly challenging the bottom line of the law and endangering the development of the sports industry.Therefore,to establish more legally deterrent prevention and acceptance measures in the field of sports“fandom”governance,firstly,it is necessary to clarify the platform's governance responsibilities from the aspects of clarifying the platform's information review obligations,optimizing dialogue mechanisms,and improving reporting mechanisms.Secondly,By combining external punishment with self-discipline and autonomy in the sports“fandom”,we aim to establish a regulatory system for the governance of the sports“fandom”.Thirdly,it is necessary to strengthen legislation,regulation,and supervision guidance on the protection of minors'networks;fourthly,the participation obligations of athletes and sports associations should be clarified in the governance of the sports“fandom”.
