摘　　要：调查核实权作为公益诉讼中检察机关履行职能、维护公共利益,顺利开展公益诉讼工作的前提和保障性权力,是公益诉讼立法的侧重点。正确行使调查核实权,是检察机关顺利开展公益诉讼工作的必然前提,关系着检察机关法律监督效能和公益诉讼职能的正确发挥。目前检察机关在行使调查核实权时依旧面临着诸多阻碍,应尽快完善相关制度设计,为检察机关履行公益诉讼职能保驾护航。The right to investigate and verify is the focus of legislation in public interest litigation,which is a prerequisite and guarantee power for the procuratorate to perform their functions,safeguard public interests and conduct work.The proper use of investigation and verification by the procuratorate is an inevitable prerequisite to carry out public interest litigation,dictating the effectiveness of legal supervision and the performance of public interest litigation functions.At present,the procuratorate have many obstacles in exercising the right of investigation and verification.So the relevant institutions should be improved as soon as possible to escort the procuratorate to perform the function of public interest litigation.
