摘　　要：历史是人类文明的象征。历史遗产是物质化、精神化的历史具象,是历史文化遗产中“历史性”的组成部分。《中华人民共和国宪法》第二十二条规定的“重要历史文化遗产”保护条款,其实是国际共识,历史价值理论、文化主权理论、言论自由与公共利益理论,构成了其理论基础。历史遗产保护应该在科学界定其范围的基础上,以保护其原真性、完整性、延续性,传承共同记忆和文明,增进国家、民族、文化与身份认同为目标,以国家利益、社会秩序、代际公平、真实公正为价值取向,坚持全面原真保护、合理利用和最小干预原则,建立以历史遗产委员会、分级保护、历史遗产名录和公益诉讼等为核心的制度体系。History symbolizes human civilization.Historical heritage embodies history in both material and spiritual forms and constitutes the"historical"component of historical and cultural heritage.Article 22 of the Constitution of the People's Republic of China mandates the protection of"important historical and cultural heritage",which is an international consensus underpinned by theories of historical value,cultural sovereignty,freedom of speech and public interest.The historical heritage should be protected on basis of a scientific definition of its scope,with the aim to preserve its authenticity,integrity,and continuity while passing down shared memory and civilization,and enhancing national,ethnic,cultural,and personal identity,under the guidance of values such as national interest,social order,intergenerational equity,and truth and justice,adhering to principles of comprehensive protection and authenticity-oriented protection,reasonable use,and minimal intervention,thus establishing a system centered on a historical heritage committee,tiered protection,a historical heritage directory,and public interest litigation.
