摘　　要：新时代运用法治思维和法治方式的法治反腐已成为解决腐败问题的根本方式,由党内法规体系和国家法律体系构建的法治反腐体系基本形成。《中国共产党纪律处分条例》属于党内法规,位于法治反腐体系前端,以惩教、规范、政治、纲纪四种功能规范前端治理,同时衔接“中后端”国家法律,其对思想和行为的调整作用及于整个法治反腐体系。中国共产党百年纪律建设和反腐败斗争史对应不同历史时期分为自在、自为、自觉、自主四个发展阶段,《中国共产党纪律处分条例》历经这四个阶段最终定型成熟。党内法规、监察法律法规、刑事法律法规已组成了协调有序的法治反腐“三端”运行机制,三端不仅系统集成运行,更有党内法规自身的内生运行、纪法融通的协同运行,以此形成反腐败合力,进一步推动纪检监察工作规范化法治化正规化建设。In the new era,anti-corruption by the rule of law,utilizing the concepts and the methods of the rule of law,has become the fundamental way to addressing corruption issues.The anti-corruption system by the rule of law constructed by the Party regulations and the national legal system has taken shape.The Regulations on Disciplinary Actions of the Communist Party of China(CPC)belong to the internal regulations of the Party and are located in the front end of the anti-corruption system of the rule of law,which regulates the front-end governance with the four functions of punishment and education,norms,politics,and discipline,and at the same time articulates with the national laws of the middle and back end.The adjusting effect on the thoughts and behaviors is also applied to the whole anti-corruption system of the rule of law.The history of the CPC's century-long disciplinary construction and anti-corruption struggle has been divided into four stages of development corresponding to different historical periods:in-itself,self-initiated,conscious and autonomous,and the Regulations on Disciplinary Actions of the CPC have been finalized and matured through these four stages.Party regulations,supervision laws and regulations,and criminal laws and regulations have formed a coordinated and orderly rule of law anti-corruption"three-pronged"operation mechanism.The three-pronged approach is not only integrated into the system but also has the endogenous operation of inner-party regulations and the coordinated operation of discipline and law integration to promote the normalization and regularization of discipline inspection and supervision work so as to form a joint anti-corruption force and further promote the normalization and regularization of discipline inspection and supervision work.
