摘  要:非羁押强制措施的数字化执行是创新应用。它的提出契合了政策导向的法律原则,弥补了传统执行方式高风险的缺陷,兼顾了经济效益与社会效益,增强了法律监督的穿透力,具有丰富的现实意义。司法实践中已经暴露出审前非羁押措施数字化执行的一些问题,主要包括取保候审数字化监管的法律基础薄弱、数字化执行方式单一、个人隐私管理的隐患重重、数字监管技术的成熟度较低以及制裁手段与违规未果后果不明。在规范和技术层面,可以通过在《刑事诉讼法》中明示数字化执行的合法性,打造多元数字化执行体系,优化监管技术丰富监管功能,细化个人信息保障条款的实施细则和严格设定程序性和实体性双重制裁后果五个角度予以完善。The digital implementation of non-custodial mandatory measures is an innovative application.It is of rich practical significance,fitting the policy-oriented legal principles,making up for the high-risk shortcomings of traditional implementation,balancing economic and social benefits,enhancing the penetrating power of legal supervision.In practice,some problem have already exposed in the digital implementation of pre-trial non-custody measures,mainly including that the legal basis for the digital supervision of the release from detention through bail is weak,the methods of digital implementation are non-richful,the personal privacy is of great danger,the digital technology is immature,and the sanctioning means and consequences of violation are uncertain.From the normative and technical aspects,improvements can be made from five perspectives,namely,making the legality of digital implementation clear in the Criminal Procedure Law,creating a multifaceted digital implementation system,optimizing the regulatory technology and enriching the regulatory function,fine-tuning the implementation details of the provisions on the protection of personal information,and rigorously setting the consequences of both procedural and substantive violation.
