类期货交易平台犯罪的分析路径与定性选择

摘　　要：期货交易规则的指引功能、评价功能、合法功能有助于判定客观行为是否具有金融属性,各行为要素组合成的客观行为是构成要件该当性分析的对象。对类期货交易平台犯罪的定性分析应当以非法经营罪作为逻辑起点,将操纵市场交易行为在非法经营罪的构成要件中展开评价。行为人除操纵行为外另行对平台交易施加系统控制性影响,造成投资人交易必然亏损的结果,控盘行为因超过了非法经营罪所规制范围而落入诈骗罪射程范围。开设赌场罪得出交易结果的偶然性、投机性和射幸性评价佐证了非法经营罪在类期货交易平台犯罪分析体系中所起到的“揭开面纱”功能。The guiding function,evaluation function and legal function of futures trading rules is conducive to determining whether objective behavior has financial attributes.The objective behavior composed of various behavioral elements is the object of constituent elements.The qualitative analysis of the quasi-futures trading platform crime should be based on the crime of illegal business operation which serves as the logical starting point of the analysis of legal interests,and be conducted considering the constituent elements of the act of using financial transaction rules to manipulate profits.Besides manipulating,the actor exerts a systematic control influence on the platform transaction,resulting in the inevitable loss of the investor′s transaction,which should affirm the crime of fraud other than the crime of illegal business operation.The guiding significance of the determination of the crime of opening a casino lies in the fact that the accidental,speculative and lucky evaluation of the transaction results supports the "veil piercing" function of the crime of illegal business operation in the quasi-futures trading platform crime.
