《刑事诉讼法》再修改中单位犯罪刑事诉讼程序的完善

摘　　要：我国在1997年《刑法》总则中设立“单位犯罪”专节,从立法上肯定了单位作为犯罪主体的地位。然而,由于1996年《刑事诉讼法》修改在前,1997年《刑法》增设单位犯罪在后,因而1996年《刑事诉讼法》没有专门规定单位犯罪案件的审理程序。此后,《刑事诉讼法》虽经2012年、2018年两次修改,但均未予涉及单位犯罪案件的审理程序,仅在最高法司法解释及相关规范性文件对此作出了一些规定,导致单位犯罪刑事诉讼程序在全面性与体系性上存在不足。对此,本文通过梳理我国单位犯罪刑事诉讼程序法制的历程,考察域外法人犯罪刑事诉讼程序类型化,从而为我国单位犯罪刑事诉讼程序提供有益借鉴。基于此,在《刑事诉讼法》第四次修改时有必要增设单位犯罪刑事诉讼程序,并从立法体例、地域管辖规则、单位刑事强制措施、涉案单位侦查协助义务、诉讼代表人出庭规则等方面加以完善。In 1997,China established a specific section on“unit crime”in the General Principles of the Criminal Law,affirming the status of units as criminal entities.However,due to the sequence of amendments to the Criminal Procedure Law in 1996 preceding the addition of unit crime in the 1997 Criminal Law,the 1996 Criminal Procedure Law failed to specifically address the trial procedures for unit crime cases.Subsequent revisions to the Criminal Procedure Law in 2012 and 2018 did not address the trial procedures for unit crime cases,only providing some regulations in judicial interpretations by the Supreme People’s Court and related normative documents,resulting in inadequacies in the comprehensive and systematic handling of criminal procedures for unit crime.This paper reviews the legislative process of criminal procedure law related to corporate crime in China and examines the typification of criminal procedures for foreign legal entities to provide beneficial insights for improving the criminal procedure for unit crime in China.Therefore,it is necessary to incorporate the criminal procedure for unit crime in the fourth amendment of the Criminal Procedure Law,addressing legislative principles,jurisdictional rules,coercive criminal measures against units,obligations for investigative assistance from involved units,and rules for legal representatives’appearances in court.
