“人类命运共同体”视阈下虚拟货币跨境洗钱犯罪治理的理论逻辑、现实困境及中国方案

摘　　要：随着中国的综合国力及国际地位的提升,中国参与全球治理的能力越来越强,提出了构建“人类命运共同体”的倡议。然而,伴随区块链技术在金融领域的广泛应用,虚拟货币跨境洗钱犯罪的全球化扩张已经对世界金融秩序造成了巨大威胁,洗钱犯罪与恐怖主义犯罪的日趋融合也给国际社会治理此类犯罪带来了较大的挑战。为加强虚拟货币跨境洗钱犯罪治理合作,尝试提出以下方案:秉持“共商、共建、共享”的合作理念,加强国家间的政治互信;坚持“可持续发展理念”,持续推进我国金融监管制度与国际接轨;坚持“多元协同治理”理念,积极完善国际司法协作法律体系;建立以亚投行为支点的警务联合协调指挥机构,加强国际警务合作彰显大国责任。With the enhancement of China’s comprehensive national strength and international status,the country has strengthened its role in global governance by proposing the initiative to build a“Community with a Shared Future for Mankind”.However,the widespread application of blockchain technology in the financial sector has led to the global expansion of cross-border money laundering crimes involving virtual currencies,posing significant threats to the world financial order,while the increasing convergence of money laundering and terrorism-related crimes presents considerable challenges for international governance.To enhance cooper-ation in combating cross-border money laundering involving virtual currencies,the following strategies are pro-posed:uphold the collaborative principle of“consultation,construction,and sharing”to strengthen political trust among nations;adhere to the concept of“sustainable development”to continuously align China’s finan-cial regulatory framework with international standards;embrace“multi-faceted collaborative governance”to actively improve the international legal framework for judicial cooperation;and establish a police coordination and command center anchored by the Asian Infrastructure Investment Bank to enhance international police co-operation and demonstrate major country responsibility.
