摘　　要：刑事拘留制度的修改有助于保障被追诉人权利,落实“慎押”的要求,契合轻罪治理的时代背景。目前,我国刑事拘留存在不少问题,刑事拘留适用率偏高、时间偏长,多种类的刑事拘留缺乏规范,缺少无证拘留制度,刑拘直诉机制对刑事拘留错用等。刑事拘留制度的修改,应当明确刑事拘留以紧急状态为适用前提,取消延长至30日的规定,叫停刑事拘留直诉制度改革,在适用条件中增加刑罚要件,建立无证拘留制度。The Third Plenary Session of the Twentieth Central Committee of the Communist Party of China pointed out the need to improve coercive measures relating to the personal rights of citizens,and coincided with the fourth revision of the Criminal Procedure Law,so that reform of the criminal detention system deserved the attention it received.The reform of the criminal detention system will help to safeguard the rights of those being prosecuted,and will help to implement the requirement of‘prudent detention’,which is in line with the requirements of governance in the era of misdemeanours.At present,there are a number of problems with criminal detention in China,including a high rate of application of criminal detention,long periods of time,a lack of regulation of many types of criminal detention,and the misuse of criminal detention by the mechanism of direct prosecution of criminal detention.The modification of the criminal detention system,should be clear that criminal detention in a state of emergency as a prerequisite for the application of the cancellation of the provisions of the extension of up to 30 days,call off the reform of the criminal detention direct prosecution system,negate the possibility of sentencing to imprisonment in the case of the use of criminal detention measures,the procuratorate to decide the extension of criminal detention.
