摘 要:让农民富起来是农村工作的重点,促进宅基地使用权流转是国家农村土地改革的主要内容。法律允许农村宅基地使用权流转有利于土地资源的优化配置、城乡之间的统筹发展、农村经济的快速增长、宅基地私下交易的整顿治理。我国农村宅基地使用权流转具有法理基础、具备政策引领、具备实践经验。目前,宅基地使用权流转在法律上存在以下问题:流转主体财产权能不完整、流转范围和形式受到限制、流转缺少有效的监管机制、缺少科学的价值评估机制、缺少合理的收益分配机制。通过对这五个方面进行完善,改变不足,来构建我国农村宅基地使用权流转法律制度,有助于发挥我国宅基地使用权的价值功能。Making farmers rich is a priority of our rural work,and promoting transfer of the right to use homesteads is a main task of rural land system reform in China.The legislation of transfer of the right to use homesteads is conducive to optimal allocation of land resources,coordinated development between urban and rural areas,rapid economic growth in rural areas,as well as regulation of private homestead transactions.Although we have got legal basis,policy guidance,and practical experience concerning transfer of the right to use homesteads,there are still some legal issues to be solved,including incomplete property rights and functions of transferors,limited scopes and forms of transfer,and lack of mechanisms for effective regulation,scientific value evaluation,and reasonable income distribution.From the above mentioned five aspects,we can achieve the legislation of transfer of the right to use homesteads in China,and make full use of the right’s value and functions.
