摘 要:随着社会的发展,家校合作愈发受到重视。本文首先依据时间线索梳理了自新中国成立以来家校合作的相关法律,进一步明确了家校合作在法律体系中的地位变迁。可以划分为三个时间段:初始阶段,家校合作的边缘地位与法律缺失;发展阶段,家校合作地位提升与法律保障初现;以及完善阶段,家校合作受到重视与法律保障完善。然后进一步分析了当前家校合作相关法律的不足,如法律体系的不完善、法律执行与监管的困境。为应对这些挑战,可以通过完善家校合作相关法律,提升法律执行与监管效力以及借鉴家校合作相关立法以期推动家校合作法治化进程,为构建更加和谐的教育环境提供坚实的法律保障。With the development of society,more and more attention is paid to home-school cooperation.This paper first sorted out the relevant laws of family-school cooperation since the founding of New China according to the time clue,and further clarified the status change of family-school cooperation in the legal system.It can be divided into three periods:the initial stage,the marginal status of home-school cooperation and the lack of law;in the development stage,the status of home-school cooperation is promoted and the legal protection is emerging;and in the improvement stage,homeschool cooperation is valued and the legal protection is perfected.Then it further analyzes the shortcomings of the current law on home-school cooperation,such as the imperfection of the legal system,the dilemma of law enforcement and supervision.In order to deal with these challenges,we can improve the laws related to home-school cooperation,enhance the effectiveness of law enforcement and supervision,and learn from the relevant legislation of home-school cooperation to promote the process of the rule of law of home-school cooperation,and provide a solid legal guarantee for the construction of a more harmonious educational environment.
