网络服务商版权审查义务的正当性证成

摘　　要：移植于美国的以“通知—必要措施”规则为主体的网络版权治理体系,是一种网络服务商不需要积极保护版权的极端模式。随着互联网商业模式的不断升级,“通知—必要措施”规则日渐失灵和异化,其在网络版权治理体系中的必要但不充分性日益显现。在保留和完善“通知—必要措施”规则的基础上,要求网络服务商承担适当的审查义务逐步成为各国完善网络版权治理体系的立法方向。在版权人、网络服务商、政府和消费者组成的版权保护系统中,按照“守门人”理论,由作为信息中枢和核心商业主体的网络服务商承担适当的审查义务具有必要性。而且,“网络中立”或“技术中立”理论并不构成网络服务商承担审查义务的理论障碍。相反,承担一定的审查义务,不仅具有经济和技术可行性,更有利于网络服务商自身商业模式的完善与升级。The network intellectual property governance system based on the"notice-remove"rule,transplanted from the United States,is an extreme model where network service providers do not need to actively protect intellectual property.With the continuous upgrading of the Internet business model,the"notice-remove"rule is becoming increasingly ineffective and alienated,and the necessity but inadequacy of the"notice-remove"rule in the network intellectual property governance system is increasingly apparent.On the basis of retaining and improving the"notice-remove"rule,requiring network service providers to undertake appropriate review obligations has gradually become the legislative direction for countries to improve their network intellectual property governance system.In the intellectual property protection system composed of intellectual property owners,network service providers,government,and consumers,according to the"gatekeeper"theory,it is necessary for network service providers,as information centers and core business entities,to assume appropriate review obligations.Moreover,the theory of"network neutrality"or"technology neutrality"that has been distorted for a long time does not constitute a theoretical obstacle for network service providers to assume the obligation of governance.On the contrary,assuming certain governance obligations not only has economic and technological feasibility,but also is more conducive to the improvement and upgrading of the business model of network service providers themselves.
