摘 要:作为行政诉讼改革的主要举措之一,行政争议诉前调解的核心是实质化解行政争议。但其理论研究的不足以及实践中产生的各种问题,为这项制度的实施带来了一定的困扰。在实质化解行政争议中,诉前调解制度的机理在于:一方面诉前调解具备政治功能属性与制度比较优势,另一方面诉前调解能在我国行政诉讼制度中实现自洽,并能妥善处理与行政审判以及诉中调解的关系。而基于实践需求,则需要对诉前调解的规则体系与运行体系进行建构,包括在规则上实现诉前调解的范围有限化、程序规范化与结果效力化,在运行中实现主体中立化与内容兼容化。As one of the major initiatives of the reform of administrative litigation,the core of pre⁃litigation mediation of administrative disputes is the substantive settlement of administrative disputes.However,the lack of theoretical research and various problems arising in practice have caused certain problems in the implementation of this system.In the substantive settlement of administrative disputes,pre⁃litigation mediation system mechanism is:on the one hand,pre⁃litigation mediation with political function attributes and system comparative advantage;on the other hand,pre⁃litigation mediation can be realised in China's administrative litigation system self⁃consistency,and properly deal with the relationship with the administrative trial and mediation in the litigation.And based on practical needs,and the need for pre⁃litigation mediation rules and operation system for the construction of the system,including the rules of pre⁃litigation mediation to achieve a limited scope,procedural norms and results of the effectiveness of the operation of the subject of neutrality and compatibility with the content of the operation.
