论婴幼儿照护的国家义务

摘　　要：长期低生育率与生育政策的优化凸显出我国现行家庭化婴幼儿照护模式的弊端与危机,要求国家积极介入并提供全方位支持。本文基于家庭婴幼儿照护的公共属性与国家在儿童发展领域的投资理论,目的性解释宪法“家庭和儿童国家保护”条款,充分证成婴幼儿照护的国家义务;借助辅助性原则的“自我负责-辅助义务”框架,阐释婴幼儿照护中家庭主体责任与国家辅助性义务的理论划分与立法适用。Low fertility rate and state's fertility policy optimization have revealed the crisis of family childcare in China,requiring state supports to perform its public functions and social value.We make a deep interpretation of Article 49(“the family and child protection clause”)of the Constitution on the basis of children's state investment theory,in order to verify the justification of state obligations of childcare(age 0-3).Then,it clarifies the family responsibility and state obligations in childcare and its legislative application,based on the“self-responsibility vs.subsidiary obligation”framework.
