基于扎根理论的国外档案出境立法考察及启示

摘　　要：国外档案出境相关立法对于我国完善档案出境法律规制具有重要借鉴意义,有助于我国健全档案法律法规体系,促进档案出境合法治理实现内外衔接。采用程序化扎根理论的三级编码分析方法,对收集到的32部国外档案出境相关法律法规进行文本分析,归纳国外档案出境立法的主范畴,并提取其核心要素的内在关系。基于国外档案出境立法内容分析,总结其对我国的启示:确立重要档案不可渡让的行为准则、厘清档案出境许可对象的范围边界、消解档案出境监管主体的权责背离、细化档案出境违法惩戒的条文规定。Overseas legislation related to the cross-border transfer of archives has important reference significance for China to improve the legal regulations for the cross-border transfer of archives.It will help China improve the legal system of archival laws and regulations and promote the internal and external integration of the legal governance of archives cross-border transfer.Using the three-level coding analysis method of the proceduralised grounded theory,this research conducted text analysis on the collected 32 laws and regulations related to the cross-border transfer of archives,summarized the main categories of overseas legislation of archives cross-border transfer,and extracted the internal relationship of its core elements.Based on the content analysis of overseas legislation related to the cross-border transfer of archives,the research summarized its implications for China's archives legislation:establishing the code of conduct of non-transferability of important archives,defining the scope and boundaries of the objects of archives cross-border transfer permits,resolving the discrepancy between the rights and responsibilities of the supervisory bodies for archives cross-border transfer,and refining the provisions of the penalties for violating the law on archives cross-border transfer.
