数字技术赋能纪检监察工作的现状、制约因素与法治路径

摘　　要：数字技术赋能纪检监察工作是加强反腐败能力建设的重要举措,是理论研究的前沿议题。通过对数字技术赋能纪检监察工作的模式、成效、制约因素和法治路径进行实际调查和规范分析后发现:各地通过运用云计算、区块链、数字孪生技术等显著提高了纪检监察工作的信息化程度、透明度和公信力,以及工作科学化、程序化、规范化水平和证据收集的准确性有效性;数字技术赋能面临技术决策性依赖、数据孤岛与“谎言”现象、数据权利与安全保障中的内在矛盾等方面的制约。应当通过强化纪检监察价值引领和理性判断机制建设,建立数据互联互通法律制度,健全个人信息权利保护和数据安全法律体系,为数字纪检监察健康发展和高效运行提供坚实的法治保障。Empowering disciplinary inspection and supervision work with digital technology is an important measure to strengthen anti-corruption capacity building and a cutting-edge topic in theoretical research.The paper mainly conducts empirical investigation and normative analysis on the mode and effec-tiveness,constraining factors,and legal path of digital technology empowering discipline inspection and su-pervision work.Research has found that various regions have significantly improved the informatization level,transparency and credibility,scientific and procedural standardization level,and accuracy and effectiveness of evidence collection in disciplinary inspection and supervision work through the use of cloud computing,blockchain,digital twin technology,and other technologies;However,the empowerment of digital technology faces constraints in terms of technological decision-making dependence,data island and‘lies’phenomenon,and inherent contradictions in the protection of data rights and it’s security.The solid legal guarantees should be provided for the healthy development and efficient operation of digital disciplinary inspection and supervi-sion by strengthening mechanism construction of the value guidance and rational judgment of disciplinary in-spection and supervision,establishing a legal system for data interconnection and improving the legal system of protecting personal information rights and data security.
