检察监督视野下海洋违法涉罪案件行刑衔接机制研究——以G省Z市司法实践为研究视角

摘　　要：建立完善的行刑衔接机制,对当前海洋违法涉罪案件的高效处理具有重要的现实意义。以G省Z市司法实践为研究对象,对代表性地区执法体系与实务困境开展实证研究。研究结果发现:当前海洋违法涉罪案件行刑衔接机制在实际运行中存在执法职责不清、正反向衔接阻碍、监督缺位等问题。基于研究结论,建议从构建权责统一的执法体系、完善执法工作机制、强化检察监督职能等多个维度,打通行政执法与刑事司法之间的壁垒,推动海洋领域法治建设。It is of great practical significance for the efficient handling of current marine illegal and criminal cases to establish a sound connection mechanism between administrative law enforcement and criminal justice.With the judicial practice in City Z Province G as the research object,an empirical research is conducted by analyzing the law enforcement system and practical difficulties in the representative region.The research findings reveal that in the actual operation of the connection mechanism between administrative law enforcement and criminal justice in marine illegal and criminal cases,there exist such problems as unclear law enforcement responsibilities,obstacles in both forward and reverse connections,and the absence of supervision.Based on this,it is suggested that the barriers between administrative law enforcement and criminal justice be broken down so as to promote the legal construction in the field of ocean through the construction of a law enforcement system with unified powers,the improvement of the law enforcement working mechanism and the strengthening of the procuratorial supervision function.
