摘　　要：我国是考试的发源地,从古至今考试就一直担当着为教育、社会和国家识才、辨才、选才的重任,并为促进社会、国家和人自身的发展起到了不可估量的作用。用法律的形式来确定它的地位和功用,并使考试制度成为国家治理制度的重要组成部分,其一,有利于构建社会主义和谐社会;其二,有利于填补我国法律空白,完善法律体系;其三,有利于规范考试活动,促进考试管理法制化;其四,有利于维护社会公平公正,为国家选拔"真才"。Our coutry is the birthplace of examination, and from ancient times, examination has been played an important role in recognising, identifying and selecting persons with ability for our ed ucation, society and country, and the effect it did on the progress of society, country and people self is invaluable. In the form of law to determine its status and function, and make examintion system as one of the country’s fathering system will help building a harmonious society, filling the gaps in Chi na’s legal to perfect the legal system, standardizing the examination management activities to promote the examination of the legal system, safeguarding social fairness and justice conducive to choose real abilities.
