刑事附带民事诉讼精神损害赔偿问题的思考

摘　　要：我国刑事诉讼法规定的附带民事诉讼的赔偿范围仅限于物质损失,而不包括精神损失。我国刑事法律制度与民事制度对精神损害诉讼的不同规定,造成立法不统一。因此,应扩大刑事附事民事损害赔偿的范围,设立附带民事诉讼精神损害赔偿。The Chinese criminal law has description only of the physical compensation for the incidental civil action,without including the spirit harm. The different regulations of spirit compensation in criminal law and civil law lead to different legislations. Therefore,the scope of compensation in criminal law should be enlarged and the spirit harm compensation should be included.
