摘　　要：本文从高校管理与学生权利冲突的案例出发,分析了冲突的具体原因,阐明了高校在有法可依的情况下仍然违法的事实,并以该事实为启示,提出了高校管理在既有自主制定程序的责任,又有担任执行者的权利的双重身份下,必须在良法的基础上做到善治,修好良法与善治的必修课。From the Case of College Students' Rights and Conflict Management, we analyze the specific reasons for the con-flict to clarify the legal basis for colleges and universities in the fact that the case is still illegal, and the fact revelation, pre-sented in both autonomous university management developed under the responsibility of the program, but also the rights of performers as the dual role of good governance must be done on the basis of good law, good law and good governance rep-aired a required course.
