摘　　要：刑法立法表述失范现象在逻辑方面表现为:并列使用具有属种关系、种属关系的概念;逐一列举概念的外延以致刑法条文缺乏简洁性;混淆使用相关概念;误用规范模态词而造成刑法规范自相矛盾和法定刑适用悖论。科学的刑法立法表述应当遵守概念间外延关系的逻辑规则,正确使用概念的概括理论,遵守形式逻辑的同一律、不矛盾律和规范逻辑的基本规则。There existsanomie of legislative expression of penal code,including using upperseat concepts and sub concepts side by side,listing denotation of relative concepts which leads some articles to lack of brevity in penal code,obscuring modalities which causes internal contradiction in articles. Legislative expression of penal code should scientifically comply with logical rules,namely the basic rules of formal logic and normal logic.
