摘　　要：疑难案件是德沃金理论关注的中心。德沃金在对实证分析法学和现实主义法学进行批判和继承的基础上建立起了自己的理论体系。其疑难案件理论可分为两个发展阶段 :一为原则确证 。Hard cases are the center of Dworking's theory. Based on his criticism and inheritance of positivistic analytics and realistic jurisprudence, he established his own theoretical system. The development of his theory can be divided into two stages: justification by principles and constructive explanation.
