摘  要:我国劳动合同试用期制度的立法初衷主要是在刚性解雇保护制度背景下,使用人单位能够较简便、快捷解除不符合要求的劳动者,适当降低用人单位的风险,实现人力资源的合理高效配置,充分促进就业。为更好地实现试用期制度的立法初衷,相关具体制度应当改善。比如,约定试用期超过法定试用期限时,劳动者应当有权选择确定超期无效或反推确定劳动合同期限;试用期工资低限标准应当予以明确;对"录用条件"应当作出广义理解的相关规定,相关法条应当修改为"经试用期考察劳动者不符合录用条件的,用人单位可以解除劳动合同",约定了服务期的劳动者在试用期内提出辞职的不支付违约金等。The original legislation intention of our country labor contract probation period system is mainly under the background of rigid dismissal protection system, employers can be more convenient and quickto dismiss the workers that did not meet the requirements, to reduce the units employing risk,to realize rational and efficient allocation of human resources and full employment.In order to achieve better the original legislation intention, the related system about probation period should be improved. For example, the arrangement probation period in excess of the statutory period of probation,employee shall have the right to choose overdue invalid or backstepping determine the term of the labor contract. low limit standard of probation salary should be clear. 'the conditions of employment' should be ruled by the way of general understanding.The relevant provisions should be amended to 'after the probation period,if the employee does not meet the conditions of employment, the employer may terminate the labor contract'.Workers agreed service period offered to resign employee during the probation period need not pay liquidated damages.
