摘　　要：集体建设用地使用权的收回是平衡农民集体和集体成员之间利益的重要制度保障,但目前我国对集体建设用地使用权等用益物权的消灭、收回的法律规定过于简略,并且收回行为既包括民事行为也包括行政行为,混淆了集体建设用地使用权收回行为的性质。应从物权变动视角确定集体建设用地使用权收回的涵义,并从所有权保护角度拓展其内涵,使之符合集体土地的特性。在此基础上,从民事法律规范角度,按照土地所有权及用益物权的运行逻辑,通过对目前集体建设用地使用权收回行为作类型化处理、明确收回的对象、规范土地所有权人撤销权的行使等措施重构集体建设用地使用权收回制度。Taking back collective construction land use right is an important institutional guarantee which can balance the benefit between farmers' collective and its members. But at present our country's legal regulations extinguishment and eviction of construction land use right and other usufructuary rights are too simple and hasty,and the act of eviction includes not only civil act but also administrative act,which further confuses the nature of collective construction land use right's eviction. We should analyze the implication of collective construction land use right's eviction from the perspective of the change of real right,and expand its connotation from the point of view of member rights protection,to comply with the characteristics of the collective land. On this basis,from the angle of the supervision from the civil code,and according to the operation logic of land ownership and real right,we should restructure the system of collective construction land use right's eviction from the following aspects: doing the type treatment on current collective construction land use right's eviction,defining the object of eviction,and regularizing and standardizing the exertion of the owner of the land's right of rescission.
