从"4·20体彩案"看体育彩票的刑法保护

摘　　要：对"4·20体彩案"中争议较大的问题进行了刑法分析,以此为基础,进一步论述了我国在体育彩票方面已有了较为完善的刑法保护,认为体育彩票发行属于现行《刑法》中的生产经营,司法机关应充分利用现行《刑法》及时、有力地打击严重危害体育彩票的行为,确保体育彩票业的健康发展。提出了出奖违例的概念,并给予了界定,特别对以非法占有彩票发行人较大数额奖金为目的而实施确能控制出奖的违例行为,对不能完全控制出奖但却实施了足以破坏彩票发行的违例行为,对国家机关工作人员滥用职权或玩忽职守而导致他人有可乘之机并实施了足以破坏彩票发行的违例行为,依据现行《刑法》确定了罪名。The authors study the most controversial issues in the 'April20 Sports Lottery Case' on the basis of the Criminal Law.In China,perfect protection in sports lottery by Criminal Law has been established.Sports lottery,considered as production and management in the Criminal Law,should be protected through prompt and effective measures to stop actions harmful to the sports lottery.Connotation of violation in drawing the lottery in public and announcing the winners is defined.Crimes including controlling the lottery drawing in order to occupying the money award of the lottery issuers,abuse of authority and of duty of state personnel leading to other peoples destruction of the lottery issuing are defined.
