知情同意权的法律构成要件浅析

摘　　要：患者有效的知情同意应包括 5个方面的构成要件 ,即知情同意权的主体应是患者本人及其法定代理人 ,知情同意必须是出于患者的自愿 ,知情同意的内容和形式应合法 。The patient's effective informed consent should include five compenents. The body of the informed consent should be the patient himself and his legal repreentative; the informed consent should come from the patient's free will; the contenet and form of the informed consent should be legal, and the informed consent should be made before the carryent of medical treatment.
