摘　　要：沉默权作为刑事诉讼中犯罪嫌疑人、被告人的基本权利 ,我国现行法律却采取反对和否定的态度 。Being the basic right of the criminal su spect and the accused, silence right is being adopted with an opposife and negat ive attitude in our present law. This paper, according to our prac tical situation, will analyze the reason about it.
