摘  要:在房地产预售过程中 ,预售双方在签订正式的预售合同之前往往会预先订立一个房地产认购书。此房地产认购书的法律性质如何 ,实有进行探讨的必要。在此基础上文章进一步讨论了如果预售双方没有依约履行房地产认购书所确定的义务 ,应如何承担相应的法律责任。In the process of real estate advance sale, both parties of advance sale usually conclude an application for real estate subscription before the signature of a formal advance sale contract. It is indeed necessary to probe into what legal nature this application for real estate subscription has. Based on this exploration, the article further discusses about how to bear corresponding responsibilities if both parties of advance sale haven't performed the obligations established in the application for real estate subscription according to agreement.
