摘　　要：鉴定人制度中的一个重要理论问题是鉴定人的诉讼地位问题,即鉴定人应否属于证人范畴的问题。通过对我国现行法律规定的分析,指出我国在这个问题上的矛盾以及建立专家证人制度的现实性和合理性。One of the important problems in identifier system is about the identifier's litigation status, that is, the problem whether identifier belongs to the category of witness or not. In this paper, the author points out not only the contradiction about the problem in China but also the actuality and rationality of establishing expert witness system.
