中国侦检关系模式理性透视——兼论我国不宜实行“侦检一体化模式”

摘　　要：中国现行侦检关系受制于线型诉讼结构,存在诸多弊端而有待完善。但是,“侦检一体化”模式不符合中国侦检关系模式的设置,不具备实践可行性。对此,应当加强检察机关对侦查活动的监督、制约,并且对于拒绝监督与制约的,予以惩戒。同时增强辩方力量,实现审前程序控辩平衡。Chinese current detection and inspection relation is restricted by the litigant linear structure; it has a lot of shortcomings and has to be improved. However, the whole body mode of detection and inspection is not fit for Chinese current detection and inspection relation, and it has not feasibility in practice. Therefore, inspection organ must strengthen supervision on the detection activity and we must punish for the action of repudiation. At the same time we should add the opponent force and realize the balance of accuser and accused.
