动产抵押权的设定及其公示效力研究

摘　　要：动产抵押制度是顺应社会经济发展而产生的。通过分析得出,动产抵押的设定包括订立抵押合同和办理抵押登记两个方面,动产抵押权的公示是确保担保权效力及保障交易安全的必要手段,而我国物权立法对动产抵押采用的是书面形式的登记对抗主义的公示方式。最后着重论述了动产抵押权的设定及其公示效力,对动产抵押权作了进一步探究。Chattel mortgage system appeared with the development of social economic. China's property law made more comprehensive provisions on the Chattel mortgage system,which has indeed played an important role in promoting economic development and ensuring transaction security. The chattel mortgage setting includes chattel mortgage contracts and mortgage registration. The Announcement of Chattel mortgage is necessary means of ensuring security rights effect and the transaction security. Chattel mortgage,as a security interest,must be announced. We must choose the announcement of chattel mortgage system. China's 'Property Law'unified set of registration antagonism of the chattel mortgage. This will focus on the establishment of chattel mortgage and the announcement effect,to further study chattel mortgage.
