摘　　要：刑事庭前审查是构成一个完整的审判程序的基本组成部分 ,起到抑制公诉权和保障审判顺利进行的作用。文章性质和特征、原则以及功能三个方面对庭前审查程序进行法理阐释 ,并对英、美、法德四国的庭前审查程序进行比较研究。在此基础上分析了我国庭前审查程序只重视排除预断 ,而忽视了该程序的抑制公诉和庭审服务功能的缺陷 。The pre examination of a criminal trial is one of the fundamental parts which make a complete trial process. It holds the function of limiting the right of public prosecution and protecting the smoothness of the trial. The thesis gives nomological explanations to the process of pre examination from three sides of nature, character and function and compares that in UK, USA, France and Germany. Then analyzes the defects in China's process of pre examination and indicates its suggestions to the re construction of the process of pre examination.
