摘　　要：鉴于制度、法律的刚性制约作用,在涉及以权利、道德、权力制衡权力的选择时,法治资源较德治资源具有优先意义,尤其是在由垄断型权力体制向竞争型权力体制转型的失范时期。权利意识是确立以德治警方略的核心要素,对个人尊严、民主权利、物质待遇等方面的重视对于激励民警认真行使执法、管理权力都有十分重要的价值。在传统道德资源中,做官先做人、官德为先的思想有着不可或缺的借鉴作用。The resource of rule of law should be claimed precedence over the resource of rule of morals, especially in a disordered time from monopoly power system to competitive power system, in view of the restrictive functions of rigid legal regulations and system, while we face rights, morals and powers, make a decision how to choice. In the reconstruction of political democracy and people dignity, right awareness is the key factor of establishing a general plan for police governed by morals, it is significant to encourage police to take an administration and enforcement at law.
