从侦审一体化困境看我国侦诉关系的重塑

摘　　要：侦审一体化机制是我国公安机关进行刑侦体制改革以来推出的一项重要举措。从目前改革的效果来看 ,这项举措由于仅仅立足于公安机关自身工作方式的调整 ,立足于为提高自身部门效率为主的利益倾向 ,而没有融入到刑事诉讼整体改革的视野中去 ,改革并没有完全贯彻侦审一体化原则的主张 ,并有疏离侦诉关系之嫌 ,其合理性值得探讨。侦审一体化机制在实践中面临的虚置困境 ,昭示出我国侦查制度的改革必须要遵循相应的诉讼规律 ,密切侦诉关系必须成为未来我国侦查制度改革的重点 ,并且这种改革并非仅仅是检察机关和侦查机关自身内部工作方式的转变问题 ,而应该上升到国家诉讼体制改革的高度 ,由相应的部门协调一致 ,通过立法予以确定 。To integrate criminal investigation and interrogation is an important measure in the reforms of criminal investigation in China.But in the reforms,the measure is only based on the policy adjustment of the public security organs themselves and on the interests tendency that gives priority to efficiency.It is not integrated in the criminal procedure reforms on the whole.Therefore,the rationality is worth discussing.That the integration system of criminal investigation and interrogation is in a dilemma indicates that the reforms of criminal investigation system in China should follow the rules of criminal procedure reforms.
