试论检察机关提起民事公益诉讼的有效方法

摘　　要：在目前的司法实践中 ,检察机关提起公益诉讼主要采用提起民事诉讼、支持民事诉讼或者利用检察机关作为法律监督机关发出检察建议或调解的非讼方式。具体采用何种方法要看具体情形而定。检察机关提起民事公益诉讼的程序一般要经过立案、调查取证及起诉等阶段。从现有的法律规定来看 ,对检察机关开展民事公益诉讼还没有具体的规定 ,亟待从立法上加以规定。Presenting civil prosecutions, supporting civil prosecutions, or as the legal supervision organ, issuing suggestions and making extrajudicial conciliation have been the main methods for procuratorial organs to present civil public prosecutions in recent legal practice. It depends whether one way or another is to be adopted. The usual procedures for procuratorial organs to present civil public prosecutions involve placing a case on file, evidence-taking and prosecuting. The author suggests rules and regulations be laid down as there are still no definite legal rules in this respect.
