建立我国破产监督人制度之构想

摘　　要：破产监督人是代表全体债权人利益 ,对破产程序进行日常监督的常设机构 ,其目的是防止破产管理人权力的滥用和失控 ,优化各利益主体之间的相互关系 ,使破产程序沿着合法、有序的轨道运行 ,从而确保破产财产公平清偿给所有债权人。目前世界上多数国家确立了破产监督人制度 ,而中国现行破产监督机制存在明显的缺陷 ,因此有必要借鉴国外的立法经验 。The bankruptcy supervisor is the standing organization representing the interest of the whole creditors and carrying out the daily supervision of the bankruptcy procedure, whose purposes is to prevent the abuse and out-of-control phenomenon of the power of the bankruptcy managers, to optimize the mutual relation between the interest subjects, to carry out the bankruptcy procedure in a legal and orderly way and to make sure the bankruptcy assets are fairly liquidated to all the creditors. At present many countries have established the system of the bankruptcy supervisor in the world, but there exist the evident deficits in the present bankruptcy supervision mechanism in China. So it is necessary to borrow the foreign legislation experience to set up the bankruptcy supervisor system conforming to the Chinese situation.
