摘　　要：行政强制执行是行政主体针对相对方的重要武器。也是行政法学的重要内容。我国酝酿统一的《行政强制执行法》已经多年。其中行政强制执行权的归属是一个重点。以行政机关执行为主还是以法院执行为主一直是争论不休的问题。结合我国的执行实践以及国外经验,抛弃了采用单一划分标准划分行政强制执行的方法,笔者提出了以相对方权益影响之大小为主要标准兼顾其他合理划分标准的综合标准。Administration coercive measure is an important way by which the administration subject deals with the opponent and also the important content of administration's law.China has fermented the unified law of administration's compulsory execution for many years.The ownership of administration coereive measure is a key point.It is an endless debate on the problem that it is the administrative organ or the court carries out the measure.It is the same to formulate the concrete division standard.Combining the execution practice of our country with foreign experiences,and abandonig the method of single division of standard,the author puts forward the comprehensive standards based on considering the rights and interests influence of the opponent,and other rational standards an well.
