摘　　要：刑事诉讼中的超期羁押现象已成为困扰我国司法实践的一大顽症。解决超期羁押的根本措施在于制度的设计。确立侦查与羁押分离制度、羁押前的司法审查制度及羁押过程中的复查制度刻不容缓。The overdue imprisonment as a phenomenon has become a chronic symptom which hinders the judicial practice during the criminal procedure.The fundamental measure to handle this phenomenon must be on the basis of the designation of the institution.It is indispensable to set up a institution of separating between detection and imprisonment and the judicial examination before the imprisonment and re-examination during the imprisonment.
