摘　　要：侦查阶段律师应否享有调查取证权,在我国司法实践中存在不同的观点。在侦查阶段赋予律师一定的调查取证权对于维护犯罪嫌疑人的合法权益、保障律师更好地履行职责具有重要作用。目前我国律师的调查取证权未得到有效的实现,需要在立法和实践两个方面进行完善。The author was set forth the necessity which give the lawyer's investigation and obtain evidence power in investigative stage. Carrying out the lawyer's investigation and obtain ev-idence power, we should perfect the two aspects which legislation and practice.
