摘　　要：《法律适用法》第24条的确填补了我国在涉外夫妻财产关系规定中的很多漏洞,让法官在处理涉外夫妻财产关系时有法可循。但《法律适用法》第24条从实施至今,各法院和各法官对该条的理解各不相同,甚至可以说是差异较大。本文通过大量的案例从实证的角度总结了《法律适用法》第24条在司法实践中的现状和存在的分歧,其与物权冲突规范和离婚冲突规范边界的模糊是其在实践中最主要的问题。为了进一步细化夫妻财产关系的法律适用规则,明确夫妻财产冲突规范的适用范围,厘清《法律适用法》第24条与第26条、第27条和第36条各自适用的范围就显得很有必要了。Article 24 of the Law of the Application of Law has indeedfilled many loopholes in China’s provisions on foreign-related marital propertyrelations, allowing judges to have laws to follow when dealing withforeign-related marital property relations. However, since the implementationof Article 24 of the Law of theApplication of Law, different courts and judges have differentunderstandings of this article. Through a large number of cases, this papersummarizes the status quo and existing differences of article 24 in thejudicial practice of the Law of theApplication of Law, and the ambiguity of its boundary with the norms ofconflict between real rights and divorce conflict is the main problem inpractice. It is necessary to clarify the applicable scope of article 24,Article 26, Article 27 and Article 36 of the Application of Law in order tofurther refine the applicable rules of husband and wife property relations andclarify the applicable scope of the norms of husband and wife propertyconflict.
