摘　　要：冯军教授表示:“将一个国家现行有效的法规视为一个结论,是对现行法规的盲目迷信,对于共同过失犯罪我们应当结合实际需要并对世界各国刑法的相关规定及理论进行分析、比较和研究。在快速发展的社会中,以‘绝对’的眼光看待刑事法律理论是不可取的,‘事实检验’的存在,也为刑事诉讼制度的发展和改革提供了空间,而对于共同过失犯罪的认识,则是一种越来越多的风险合作行为。”我们能够对于共同犯罪能有这样深刻的认识,这为共同过失犯罪的成立提供了理论上的支持。关于交通肇事共犯的成立问题,主要从共同过失构成的大背景下进行探讨。首先,阐释本课题的选题背景、研究意义、主要结论、文章结构等对文章内容作出简单介绍。其次,说明案件争议的焦点由此提出关于交通事故共犯的刑事责任问题。然后,对各个观点的利弊提出自己的看法。吸取各国立法优点,结合我国国情论证交通肇事罪成立共同犯罪的合理性和构成要件。最后,提出对于我国立法中关于将共同过失犯罪列入刑法总则的建议纳入共同犯罪的范围内,以妥当解决我国交通肇事领域中的共犯问题。Professor Feng Jun said: “If we take the existing provisions of a country without demonstration as a conclusion, it is blind superstition to the existing provisions. For joint negligent crime, we should analyze, compare and study the criminal law provisions and theories of various countries in the world in combination with the actual needs. In a rapidly developing society, it is not suitable to examine the criminal law theory with an absolute attitude. The reality not only tests the theory, but also provides the possibility of development and reform for the theory. The recognition of losing crime is a general trend in the case of the gradual increase of dangerous cooperative behavior”. We can have such a profound understanding of joint crime, which provides theoretical support for the establishment of joint negligent crime. The establishment of accomplices in traffic accidents is mainly discussed from the background of the composition of joint negligence. First, explain the topic background, research significance, main conclusions, article structure and so on to make a brief introduction to the content of the article. Secondly, it explains the focus of the dispute of the case and raises the question of the criminal responsibility of the accomplice in the traffic accident. Then, give your own opinion on the pros and cons of each view. Drawing on the legislative advantages of various countries and combining with the national conditions of our country, the rationality and constituent elements of establishing joint crime of traffic accident crime are demonstrated. Finally, the author puts forward the suggestion of including joint negligence crime in the general provisions of criminal law into the scope of joint crime in order to properly solve the problem of accomplice in the field of traffic accident in China.
