摘 要:近年来,满足人类需求的生物技术发明不断涌现。基因驱动作为一项新兴技术,给生物技术带来了新的活力。然而,它也面临着许多问题,本文以基因驱动的可专利性为重点,探索不同的基因专利保护途径,从而平衡基因驱动的优点和缺点。文章简要介绍了基因驱动的定义,并阐述了基因驱动在传染病防治和农业中的应用。本文也探究了基因专利保护的不同途径,特别是美国和欧洲所采取的具有深远影响的方法,通过分析基因专利的潜在风险,如食品供应短缺和公共卫生风险,试图全面分析基因专利带来的影响。In recent years, biotechnological inventions that meet human needs are constantly sprouting. Gene drive, as an emerging technology, has brought new vitality to biotechnology. However, it also faces many problems. This paper focuses on the patentability of gene drive and tries to figure out different approaches to gene patent protection, thus striking a balance between the merits and demerits of gene drive. The paper briefly introduces the definition of gene drive and helps to figure out how gene drive applies in the prevention and control of infectious diseases and agriculture. Also, this paper explores the different approaches to gene patent protection, in particular the far-reaching approaches taken in the United States and Europe, and attempts to comprehensively analyze the full implications of gene patents by analyzing the potential risks of gene patents, such as food supply shortages and public health risks.
