摘 要:借名买房合同的学说性质、合同效力以及所购房屋的物权归属问题,在学术和理论上都存在一定争议。借名买房合同在性质上应当归属于无名合同的范畴当中;其合同效力也应当结合不同的情形予以考虑。此外,为保证其所购房屋物权效力以及市场秩序的稳定,其所购房屋物权应当结合借名人、出名人以及第三人的权利参与状态分别看待。The theoretical nature of the contract, the validity of the contract and the ownership of the property right of the purchased house are controversial in both academic and theoretical aspects. The contract of buying house under borrowed name should belong to the category of nameless contract in nature;The effectiveness of the contract should also be considered in light of different circumstances.
