摘 要:就业性别歧视的现象在社会中普遍存在,为了加强对女性平等就业权的保障,可以通过文献研究法与实证研究法,分析我国在该领域的保障现状,针对尚存问题提出一些完善建议。本文从我国国内的立法现状出发,透过实证案例详细剖析现实中女性平等就业权在法律保障领域面临的专门性保障法律空缺、举证责任安排不合理、权利救济方面不完善、专门性保障机构缺失等困境及成因,并结合域外相关经验提出制定专门的《反就业歧视法》、合理分担举证责任、完善权利救济各方面、构建专门性保障机构等具有针对性和可行性的建议,从而探寻一条我国就业性别平等的保障之路。The phenomenon of gender discrimination in employment is widespread in society. In order to strengthen the protection of women’s equal employment rights, we can analyze the current situation of protection in this field in China through literature research and empirical research methods, and propose some suggestions for improving the remaining issues. Starting from the current legislative situation in China, this article analyzes in detail the difficulties and causes faced by women’s equal employment rights in the field of legal protection through empirical cases, such as the lack of specialized protection laws, unreasonable arrangements for the burden of proof, imperfect rights relief, and the lack of specialized protection institutions. Based on relevant foreign experience, this article proposes to formulate a special “Anti Employment Discrimination Law”, reasonably share the burden of proof targeted and feasible suggestions such as improving various aspects of rights relief and constructing specialized security institutions which are proposed to explore a way to ensure gender equality in employment in China.
